General Terms & Conditions

Scope and Application
These General Terms and Conditions (“GTC”) govern all quotations, bookings, sales, and service contracts made between Cube Arts & Media Sdn. Bhd. (“Cube Arts”, “we”, “our”, “us”) and any Client (“you”).
These GTC cover all categories of digital creative services, including:
Itemised design services (e.g. logos, business cards, posters, corporate identity sets, websites, etc.), and
Package services (e.g. Starter, Growth, Pro and Enterprise packages) which include a dedicated designer assigned to the Client.
By purchasing or engaging Cube Arts’ services, the Client agrees to these GTC, our
Privacy Policy, and any written agreements or project-specific terms provided by Cube Arts.
No other terms shall apply unless expressly agreed to in writing by Cube Arts.
Governing Law and Jurisdiction
These GTC are governed by the laws of Malaysia, including:
The Contracts Act 1950
The Consumer Protection Act 1999 (where applicable)
The Copyright Act 1987
The Communications and Multimedia Act 1998
The Personal Data Protection Act 2010 (PDPA)
Any disputes arising hereunder shall fall under the exclusive jurisdiction of the courts of Malaysia.
Booking, Order Acceptance & Delivery Timeline
To order a service, you must choose your product on our website, provide a design brief and if available upload materials during the check-out process, and pay any required price.
Upon booking, Cube Arts will deliver an initial draft of the ordered service within the following timeframes:
Standard / small design services (e.g. logos, business cards): within 2 business days after receiving a complete design brief.
Larger design / CI-graphic sets: within 4–5 business days, subject to receipt of all necessary information and materials.
After the initial draft, you are entitled to:
One (1) major correction — substantial changes such as layout, concept, or color direction;
One (1) minor request — small adjustments such as text edits, minor layout or shading tweaks.
Cube Arts will deliver requested changes within a reasonable timeframe:
For minor tasks: up to 2 business days after receiving feedback.
For larger projects: between 2–5 business days, depending on project size and complexity.
After revisions are completed, you will receive a final version for any last minor feedback. Once received, Cube Arts will apply final tweaks swiftly and deliver the completed product.
Final delivered products are non-refundable and deemed accepted upon delivery unless written objections are made within three (3) working days.
Refund and Delivery Policy
Cube Arts’ services are digital and custom-made, thus non-returnable and non-refundable once delivered.
However, if Cube Arts fails to render the purchased service within the agreed timeframe plus five (5) working days, the Client is entitled to a full refund for that specific booking.
Once final deliverables are provided, ownership transfers to the Client. Cube Arts retains no claim of ownership except for permitted portfolio use (see Section 9).
Cube Arts may incorporate open-source or commercially licensed design elements, provided they comply with licensing rules. Cube Arts guarantees that all final designs are free of copyright infringement.
Package Services (Pro & Enterprise) and Dedicated Designer
Starter, Growth, Pro and Enterprise packages include the assignment of a dedicated designer who manages the Client’s creative portfolio.
The Client purchases an agreed number of design hours (“Consumable Time”) which are deducted only when the designer performs billable actions, such as:
Active design or editing work;
Preparing drafts or visual proposals;
Communication or consultation sessions;
File formatting, research, or post-processing;
Any design-related task undertaken at the Client’s instruction.
The designer will inform the Client before beginning any major new task of the estimated hours required. Estimates are indicative and may vary depending on change requests.
Validity: Purchased time is valid for one (1) year from the date of purchase and expires automatically thereafter, without refund or transfer.
The assigned designer may be retained if the Client tops up additional time before expiry or upon exhaustion of the previous package.
Cube Arts reserves the right to reassign designers or delegate work to other team members or freelancers where necessary for workload balance or specialized expertise.
Private Hire Prohibition:
Clients are strictly prohibited from engaging, hiring, or contacting Cube Arts’ designers, employees, or contractors directly or indirectly outside Cube Arts’ official channels or packages.
Any breach may result in immediate termination of service, forfeiture of purchased hours, and legal action for breach of contract and damages.
Consultancy Sessions
Consultancy sessions are available exclusively to Pro and Enterprise clients.
During consultancy sessions, Cube Arts’ consultant will:
Review the Client’s business or project proposal;
Understand brand goals, ideas, and values;
Evaluate brand consistency, message clarity, and visual alignment;
Provide creative and strategic feedback;
Assist the designer in aligning creative direction with the Client’s vision.
Consultancy advice is non-binding and advisory, and Cube Arts does not guarantee any specific market or commercial outcome.
Client Responsibilities
The Client shall provide timely and accurate information, instructions, and approvals.
Delays caused by incomplete materials or slow feedback release Cube Arts from any delivery obligations.
The Client must ensure they own or have rights to all materials (texts, logos, images, etc.) provided to Cube Arts.
Confidentiality
Both parties agree to maintain the confidentiality of all information and materials shared during the project.
Cube Arts shall not disclose any Client information to third parties except where required by law or necessary for project execution.
Intellectual Property Rights
Upon full payment, all final deliverables become the sole property of the Client.
Cube Arts retains the right to showcase non-confidential work for its portfolio, website, or marketing, unless the Client requests in writing that such publication be excluded.
Drafts, preliminary concepts, and editable files remain the property of Cube Arts unless otherwise agreed.
Cube Arts ensures all materials are free of copyright infringement, though may include licensed or open-source elements within compliance boundaries.
Liability and Warranty Disclaimer
Cube Arts provides all services on a best-effort basis and makes no warranty that designs will achieve any particular business or financial result.
Cube Arts shall not be liable for:
Indirect, incidental, or consequential losses;
Loss of business opportunities, data, or reputation;
Damages resulting from misuse, alteration, or third-party handling of deliverables.
Total liability for any claim shall be limited to the total fee paid for the service giving rise to that claim.
Force Majeure
Cube Arts shall not be held responsible for any failure or delay caused by circumstances beyond its control, including power failures, pandemics, natural disasters, or governmental restrictions.
Amendments
Cube Arts may update these GTC at any time. The latest version will be available on the Cube Arts website and shall apply to all new transactions thereafter.
